Protecting Your Probate Rights

We are authorised to undertake probate and estate administration by the Institute of Chartered Accountants for England and Wales (ICAEW). (Link opens in a new tab.)

Johnsons help executors and family support with the following:

  • Probate applications
  • Inheritance Tax forms
  • Estate and beneficiary tax advice
  • Advice on the process and how IHT can be mitigated in some circumstances post-death
  • Tax returns to date of death
  • Estate tax returns
  • Company valuations
  • Estate accounts

Whilst Johnsons will action work almost immediately, the reality is that probate is a legal process designed to ensure estate assets are identified and secured in full and paid out to the correct parties. This takes time, and every party involved performs their own checks and balances to ensure that they are complying with their requirements. In our experience, delays are usually caused by HMRC, who are chronically understaffed, and your financial provider, for whom responses are needed to finalise any probate application.”

As trusted probate advisors, you can be assured that the affairs of your loved ones are in good care. We are regulated by ICAEW to provide non-contentious probate (License number: C001681357). The firm has two layers of professional indemnity with a primary layer with CAN covering £1.5m (Policy Number: 10519686) and Rokstone covering a secondary layer of £1.5m (Policy Number: RPI-UK000283-01). All clients are also protected via the ICAEW Probate Compensation Scheme – details of which can be found here

In the unlikely event that you are dissatisfied with the service received from Johnsons, you should contact complaints@johnsonsca.com, setting out in as much detail as possible your concerns. The team which deals with complaints across the whole firm will endeavour to respond within 2 weeks. If at the end of the complaints process you are dissatisfied with the outcome you are welcome to report the matter to ICAEW and/or the Legal Ombudsman by writing to Legal Ombudsman, PO Box 6167, Slough SL1 0EH.
